Terms and Conditions of Use – MyDocPay (MDP)

1. Introduction

Welcome to MyDocPay Pty Ltd (ABN: 28 644 417 283) (“MDP”, “we”, “our”, “us”). These Terms and Conditions govern access to and use of our website, applications, services, and products (collectively, the “Platform”) by patients, healthcare providers, and medical practices. By registering or using MDP, you agree to be bound by these Terms.

2. Definitions

  • MDP: MyDocPay Pty Ltd

  • User: Any individual or entity using the MDP Platform (includes Patients, Providers, and Practices)

  • Practice: A registered medical practice offering services using MDP

  • Provider: A registered health professional operating under or with a Practice

  • Patient: An individual receiving services through a Practice using MDP

  • Platform: MDP’s web apps, patient and practice apps, terminals, integrations, and related tools

3. Eligibility and Access

  • Users must be at least 18 years old or have guardian consent.

  • Practices and Providers must be registered with AHPRA and comply with applicable healthcare regulations.

  • Patients must hold a valid Medicare card for subsidised MBS services.

  • Access may be restricted or revoked for misuse or breach of terms.

4. Products and Services

  • Complete Pay: MDP pays for Medicare-eligible consultations upfront. Rebates are assigned to MDP.

  • Together Pay: Co-payment product allowing deferred gap payments. Patients agree to repayment schedules.

  • Standard Payment Processing: Practices use MDP terminals or software to process patient payments, whether MDP-funded or not.

5. User Responsibilities

a. Patients

  • Consent to MDP processing Medicare claims and sharing information with their provider.

  • Transfer Medicare rebates to MDP if received directly.

  • Pay applicable gap amounts and processing fees via approved payment plans.

  • Provide accurate personal and health information.

  • Use MDP only for MBS-compliant, legitimate services.

b. Providers

  • Ensure billing is clinically justified, consistent with MBS descriptors, and clearly documented.

  • Cooperate with audit and quality assurance checks.

  • Obtain informed consent from patients regarding MDP usage.

  • Maintain secure access credentials and comply with privacy obligations.

c. Practices

  • Ensure accurate integration with clinical software (e.g. Best Practice).

  • Facilitate training and marketing for eligible patients.

  • Maintain secure custody of MDP terminals and data access permissions.

  • Ensure patient consent is obtained before using MDP services.

6. Fees and Payment

  • Subscription fees apply per provider based on practice size.

  • Processing fees apply for each transaction (e.g., 40% for Complete Pay, 5% for Together Pay).

  • Stripe is used for payment collection. Failed payments may incur charges.

  • Full reconciliation and reporting are provided.

7. Data Security and Privacy

  • MDP complies with the Privacy Act 1988 (Cth) and Australian Privacy Principles.

  • Only essential data is collected, stored securely, and shared with third parties (e.g., Stripe, Medicare) for operational purposes.

  • Users can request data access or deletion by emailing support@mydocpay.com.au.

8. Intellectual Property

All content on the MDP Platform—including software, branding, designs, and text—is the property of MyDocPay Pty Ltd or its licensors. You may not reproduce, modify, or distribute any part of the Platform without our permission.

9. Termination and Suspension

  • Users may cancel at any time but must settle outstanding balances.

  • MDP reserves the right to suspend or terminate accounts for breach of terms, misuse, unethical billing, or fraud.

10. Limitation of Liability

  • MDP is not liable for indirect or consequential loss, system downtime, or failure to obtain Medicare benefits.

  • Practices and Providers indemnify MDP from liability related to Medicare compliance breaches, billing errors, and patient disputes.

11. Dispute Resolution

  • Users should first contact MDP Support at support@mydocpay.com.au.

  • Unresolved disputes may be escalated to the Commonwealth Ombudsman or AFCA.

12. Modifications to Terms

MDP may amend these terms at any time. Material changes will be notified at least 14 days in advance. Continued use of the Platform indicates acceptance of updated terms.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in Queensland courts.
